Excavation work in New York City can quickly trigger additional requirements for protecting adjoining properties.
Two requirements that are often confused are preconstruction surveys and movement monitoring. While they are closely related, they serve different purposes and have different triggers under the NYC Building Code.
Understanding those triggers before excavation begins can help prevent DOB objections, inspection issues, construction delays, and unexpected coordination in the field.
When Is a Preconstruction Survey Required?
Under NYC Building Code BC 3309.4.3, a preconstruction survey is required when excavation meets certain depth and proximity conditions.
The purpose of the survey is to document the existing condition of adjoining structures before excavation begins. This may include existing cracks, settlement, deterioration, facade conditions, foundation conditions, and other observable conditions that could become important as construction progresses.
Example
Consider an excavation that will extend 8 feet below grade and is located 6 feet from an adjoining building. Because the excavation is more than 5 feet deep and within 10 feet of the adjoining building, the preconstruction survey requirement would apply.
Now consider an excavation that is 12 feet deep. Because the excavation exceeds 10 feet in depth, the preconstruction survey requirement applies regardless of its location on the site.
When Is Movement Monitoring Required?
Movement monitoring is addressed under BC 3309.4.4.
Generally, an adjoining building must be monitored when the horizontal distance from the building to the edge of the excavation is equal to or less than the maximum depth of the excavation.
Horizontal Distance to Adjacent Building <= Maximum Excavation Depth
Example
Assume a project has a maximum excavation depth of 15 feet and an adjoining building is located 12 feet from the edge of the excavation.
Because 12' <= 15', the adjoining building falls within the general monitoring threshold.
If that same building were located 20 feet from the excavation edge, this particular depth-versus-distance trigger would not apply.
Where Is the Horizontal Distance Measured From?
For this monitoring analysis, the horizontal distance is measured in relation to the edge of the excavation. In other words, you do not measure across the excavation itself.
Think of it as: Adjacent Building -> Horizontal Distance -> Nearest Edge of Excavation
This distinction is especially important on tight NYC construction sites, where only a few feet can determine whether an adjoining building falls within the monitoring threshold.
What About Excavations 5 Feet Deep or Less?
BC 3309.4.4 contains an exception for certain excavations that do not exceed 5 feet in depth.
This means that simply saying, “The excavation is only 5 feet deep,” does not automatically resolve the monitoring question. The excavation's relationship to nearby footings and foundations must still be evaluated.
What About Historic Structures?
Historic structures have an additional monitoring trigger.
Under BC 3309.4.4, monitoring is also required for qualifying historic structures that are contiguous to, or located within a 90-foot lateral distance from the edge of the lot where excavation is occurring.
This is different from the standard excavation-depth-versus-distance analysis. A historic structure could therefore require monitoring even when it falls outside the normal monitoring zone created by the depth of the excavation.

Preconstruction Survey vs. Monitoring: What's the Difference?
Preconstruction Survey = Document Existing Conditions Before Excavation
Movement Monitoring = Track Movement During Excavation
A preconstruction survey establishes a record of the adjoining property's condition before potentially impactful work begins. Monitoring, on the other hand, is intended to identify movement occurring while the work is underway.
Depending on the excavation depth, proximity of adjoining structures, foundation conditions, and presence of historic structures, a project may require one, both, or neither. That is why these requirements should be evaluated independently.
Why This Matters During DOB Inspections
These are not simply documentation requirements that can be addressed after excavation starts.
NYC DOB identifies preconstruction surveys and monitoring among the items that may be reviewed as part of excavation safety oversight.
Excavation-related inspections and audits can also involve review of support of excavation, underpinning, shoring and bracing, excavation depth, groundwater conditions, protection of adjoining property, and whether the work is being performed in accordance with approved construction documents.
The safest approach is to identify these requirements during the planning and coordination stage, not once excavation is already underway.
What Should Be Reviewed Before Excavation Begins?
On dense NYC sites, these conditions should be coordinated with the excavation, support-of-excavation, foundation, structural, and site safety documents as early as possible.
The Takeaway
Preconstruction surveys and movement monitoring are related, but they are not interchangeable requirements.
Preconstruction Survey: Think excavation depth + proximity to adjoining buildings.
Movement Monitoring: Think maximum excavation depth compared with the horizontal distance from the excavation edge to the adjoining building.
Historic Structures: Remember the additional 90-foot lateral-distance trigger.
For shallow excavation, do not automatically assume that being 5 feet deep or less eliminates monitoring. The relationship to nearby footings and foundations still matters.
Identifying these conditions early makes it easier to coordinate the required protections before excavation begins and reduces the chance of surprises once the project reaches the field.
